Terms and conditions

These Terms and Conditions apply to all bookings and activities provided by Kick Ups Academy (“KUA”, “we”, “us” or “our”).

By booking a place for your child on any KUA activity, you confirm that you have read, understood and agree to these Terms and Conditions.

  1. BOOKINGS

Bookings for KUA activities can be made through our online booking system or, where applicable, directly with KUA.

A booking is confirmed once the required information has been provided and payment has been received and processed.

You will normally receive confirmation of your booking by email.

Places are subject to availability and are only secured once the booking has been confirmed.

By making a booking, you confirm that the information provided is accurate and that you have the appropriate authority to register the child for the activity.

  1. PAYMENTS

Payment must be made in accordance with the payment terms shown at the time of booking.

We may accept payments through our online booking system and other payment methods made available by KUA.

All fees must be paid by the relevant payment deadline. KUA reserves the right to refuse participation where payment has not been received.

  1. CANCELLATIONS, REFUNDS AND CREDITS

Our cancellation and refund arrangements may vary depending on the type of activity booked and will be communicated at the time of booking.

Where KUA cancels an activity, we will normally offer an alternative session, credit or other appropriate arrangement.

Where an activity is cancelled due to circumstances outside of our reasonable control, including severe weather, venue closure or other unforeseen circumstances, KUA will communicate the available arrangements as soon as reasonably possible.

Unless otherwise stated at the time of booking, missed sessions or non-attendance by a participant will not normally be eligible for a refund or credit.

Nothing in these Terms and Conditions affects your statutory rights.

  1. PROMOTIONS AND DISCOUNTS

KUA may offer promotional codes, discounts or special offers from time to time.

Promotions are subject to any specific terms stated at the time the promotion is offered and may be subject to availability, expiry dates or other restrictions.

Promotional offers cannot normally be combined unless expressly stated otherwise.

  1. CHILD SAFEGUARDING

The safety and wellbeing of children is a priority at Kick Ups Academy.

Our coaches and staff are expected to follow KUA safeguarding procedures and relevant safeguarding requirements.

Where a safeguarding concern is raised or a child makes a disclosure, we will respond in accordance with our safeguarding procedures and applicable guidance.

Relevant safeguarding information may be shared with appropriate authorities or organisations where required to protect a child or where we have a legal obligation to do so.

  1. PHOTOGRAPHY AND VIDEO

KUA may take photographs or video footage during sessions, camps, tournaments, matches and other activities for promotional, marketing and social media purposes.

Where consent is required, we will obtain the appropriate consent before using identifiable images or video of children for promotional purposes.

Parents or guardians can contact KUA if they have questions about photography or video arrangements.

Personal information and images will be handled in accordance with our Privacy Policy.

  1. PERSONAL BELONGINGS

KUA is not responsible for loss, theft or damage to personal belongings brought to any activity, except where we are legally responsible.

We recommend that children do not bring valuables or unnecessary personal items to sessions.

  1. HEALTH AND SAFETY

KUA takes reasonable steps to ensure that activities are delivered in a safe and appropriate environment.

Activities may take place indoors or outdoors and can involve physical activity, including running, football drills, games and competitive matches.

Children must wear suitable clothing and footwear appropriate for the activity and weather conditions.

Shin pads are compulsory for football activities where players are participating in contact or competitive football.

KUA reserves the right to prevent a child from participating where appropriate safety equipment is not being used.

Parents and guardians are responsible for ensuring that children arrive appropriately prepared for their activity.

  1. MEDICAL INFORMATION

Parents and guardians must provide accurate and up-to-date information about any medical conditions, allergies, injuries, medication, additional needs or other information that may affect their child's participation or safety.

This information should be provided during registration and updated whenever circumstances change.

Parents and guardians should also inform the lead coach of any relevant medical information before the activity begins.

  1. FIRST AID AND EMERGENCIES

By booking an activity, parents or guardians consent to KUA staff providing appropriate first aid to their child where necessary.

In an emergency, KUA may contact the emergency services and the parent or guardian using the emergency contact information provided.

  1. COLLECTION AND LEAVING ACTIVITIES

Children must be collected by an authorised parent or guardian unless KUA has received appropriate prior written consent for the child to leave independently.

Where a child is required to be signed out, the parent or authorised guardian must follow the relevant sign-out procedure.

Parents and guardians are responsible for ensuring that KUA has accurate collection and emergency contact information.

  1. PLAYER BEHAVIOUR

We expect all children, parents, guardians and coaches to behave respectfully and appropriately.

Children are expected to follow reasonable instructions from coaches and behave in a way that does not put themselves or others at risk.

KUA reserves the right to take appropriate action where behaviour is unacceptable, including asking a child or parent/guardian to leave an activity.

Serious or repeated unacceptable behaviour may result in a booking or membership being suspended or cancelled.

  1. PARENT AND GUARDIAN CONDUCT

We expect parents and guardians to support our coaches, players and other families and to behave respectfully at all times.

Abusive, threatening, discriminatory or inappropriate behaviour towards children, coaches, officials, parents or other participants will not be tolerated.

KUA may take appropriate action where such behaviour occurs.

  1. CHANGES TO ACTIVITIES

KUA reserves the right to make reasonable changes to session times, venues, coaches, activities or programmes where necessary.

We will provide reasonable notice where possible.

Where KUA has to cancel or significantly change an activity, we will communicate the available alternative arrangements.

  1. LIABILITY

KUA maintains appropriate public liability insurance for its activities.

Nothing in these Terms and Conditions excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to the above, KUA will not be responsible for loss or damage that is not reasonably foreseeable or that arises from circumstances outside our reasonable control.

  1. COMPLAINTS

We take complaints seriously and aim to resolve concerns as quickly and fairly as possible.

If you have a concern about an activity, please speak to the senior coach or relevant member of staff in the first instance.

  1. PRIVACY

Personal information provided to KUA will be handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information.

  1. WEBSITE INFORMATION

We make reasonable efforts to ensure that information published on our website is accurate and up to date.

However, information, availability, prices, activities, venues and schedules may change from time to time.

  1. CHANGES TO THESE TERMS

We may update these Terms and Conditions from time to time to reflect changes to our services, legal requirements or how we operate.

The latest version will be published on our website, with the date of the most recent update shown at the top.

  1. GOVERNING LAW

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any rights you may have under applicable consumer protection legislation.
